Frequently Asked Questions
Answers on debt recovery, required documents, timelines, fees and how a file is handled at Bayan Legal Consultancy FZC.
What is the difference between legal consultancy and debt recovery?
Legal consultancy answers a question: what is your position, what are your obligations, what are your options. Debt recovery is an active process aimed at collecting a specific amount. Many files begin as a consultation and become a recovery matter once the position is clear.
What documents are needed to open a recovery file?
As a minimum: evidence that the amount is due and evidence of what was supplied. Typically the contract or purchase order, invoices, a statement of account, proof of delivery or completion, and correspondence with the debtor. Cheques and any acknowledgement of debt strengthen the file considerably.
Do you guarantee that the amount will be collected?
No. Recovery cannot be guaranteed. The outcome depends on the documents, the debtor's financial position, the nature of the claim, the level of cooperation and the procedures legally available. Any firm promising a guaranteed result should be treated with caution.
How long does the recovery process take?
The first approach to the debtor usually follows within days of the file being opened. Beyond that, the duration depends on the debtor's response. Some matters settle in weeks; others involve a payment plan running over months.
Do you start with amicable contact?
Yes. Professional contact and negotiation are almost always attempted first. They are usually faster and less costly than escalation, and they preserve the commercial relationship where that matters.
Can a payment plan be arranged?
Yes, and it is often the practical outcome. A plan should be documented, with clear instalments and clear consequences if an instalment is missed.
What happens if the debtor refuses to pay?
We assess the position on the documents and set out the procedures available. Where the matter requires representation before the courts, we coordinate with licensed advocates or the competent authorities, in accordance with the scope of our licence.
Do the fees include government or court fees?
No. Government fees, court fees, translation, notarisation and similar disbursements are separate from professional fees and are charged at cost.
How are fees determined?
Fees depend on the nature of the matter, the volume of documents and the work required. The basis is agreed in writing before work begins, so there are no surprises.
Can I get a consultation remotely?
Yes. Consultations can be held by telephone, video call or in writing, as well as in person.
Do you work with companies and individuals?
Both. Files are accepted from corporate finance teams, business owners and individuals.
Are my documents and information kept confidential?
Yes. Documents and information are treated as confidential and shared only where necessary to progress the matter or where required by law.
Can I upload documents through the website?
Yes. The consultation and claim forms accept PDF, DOC, DOCX, JPG and PNG files. Please do not send originals; clear copies are sufficient at the assessment stage.
Does submitting a form mean my case has been accepted?
No. Submitting a form is a request for review. Acceptance of a matter follows a separate written engagement setting out scope and fees.
Can a debt be recovered without a written contract?
Often yes. Invoices, delivery notes, statements of account, cheques and correspondence can together establish that an amount is due. The available documents are assessed at the outset.
Can you deal with a returned cheque?
Yes. A returned cheque is reviewed together with the transaction behind it, since the instrument alone rarely tells the whole story.
What is the difference between amicable recovery and legal proceedings?
Amicable recovery works through communication, negotiation and settlement. Legal proceedings involve formal procedures before the competent authorities and generally take longer and cost more.
Will I receive regular updates?
Yes. You are informed as the file develops and at agreed reporting intervals.
What payment methods are available?
Professional fees are payable by bank transfer to the company account. Details are provided on the invoice.
Can a settlement be negotiated?
Yes. Negotiated settlement is frequently the most practical outcome, particularly where the debtor acknowledges the debt but cannot pay in a single sum.
Debt recovery results cannot be guaranteed. Outcomes depend on the available documents, the debtor's financial position, the nature of the claim, cooperation between the parties, and the legally available procedures.
Do you have a legal question or an overdue receivable?
Share the details of the matter and our team will review the request and set out the appropriate next step.
